Collegial Court Den Bosch: prosecution clowns not admissible

Tuesday, Dec. 14th - 13.30: three judges of the Collegial Court (Meervoudige Kamer) gave a judgement about one of the arrested rebel clowns joining the protests against a march of neo-nazis from the NVU (Dutch Peoples Union / Nederlandse Volks Unie) in 2009 in Den Bosch. December 14th 2010 the judgement of the Collegial Court unfortunatelly doesn't tell anything about the needless emergency regulation. But it tells something about the prosecution of the clowns. Loads of words, we could keep it short and simple: "It was a mess!". It had something to do with the equality principle. The 5 arrested clowns were not treated equally. 3 clowns got different transaction proposals (200,- 220,- 250,-), 1 got a letter he shouldn't be prosecuted and 1 didn't get a letter at all.

So the judgement is: prosecution is not admissible. Which is of course nice, but doesn't make clear if clowns are allowed to wear their beautiful red noses in a city with an emergency regulation where they allow neo-nazis to march...

However: on Nov. 30th the prosecutor said a few interesting things. Clowns were clearly recognisable and the prosecutor did also understand the clowns didn't had the intention to don't follow the official orders. That's why the prosecutor asked acquittal.
Maybe these lines will help the lawyer of the clowns in future court cases. Clowns should be clowns - especially on days neo-nazis are marching!

There are a few red nose cases left. We'll see if they will drop these cases. And the remaining question is also: "Will the prosecutor ask appeal?" (2 weeks later we'll know)
